Overview
This website is operated by Elfoyo ("Elfoyo", "we", "us", or "our"). By visiting our website and/or purchasing from us, you agree to be bound by these Terms of Service and Sale (the "Terms"), including any policies referenced here, such as our Privacy Policy and Refund Policy. These Terms apply to all users of the site, including browsers and customers. Please read them carefully before using the site or placing an order. If you do not agree to all of these Terms, please do not use the site. Our store is hosted on Shopify, which provides the ecommerce platform we use to process orders. We may update these Terms at any time by posting the revised version on this page, and your continued use of the site means you accept those changes.

1. Eligibility
By using the site you confirm that you are at least 18 years old (or the age of majority where you live), or that you have the consent of a parent or guardian. You may not use our products or the site for any unlawful or unauthorized purpose or in violation of any laws that apply to you.

2. General Conditions
We may refuse service to anyone, for any reason, at any time. You understand that your content (excluding payment card information) may be transferred unencrypted across networks; payment card information is always encrypted during transfer. You agree not to reproduce, copy, resell, or exploit any part of the site or our services without our written permission.

3. Products, Pricing, and Availability
Products may be offered in limited quantities and are subject to our Refund Policy. We try to display our products and their colors as accurately as possible but cannot guarantee that your screen displays them accurately. All prices are shown in U.S. dollars and may change at any time without notice; the price that applies to your order is the one shown at checkout. Any taxes and shipping charges are shown before you complete your order. We reserve the right to limit quantities, discontinue products, correct errors, and refuse or cancel any order at our discretion, including multiple orders that appear to be placed by the same person, card, or address.

4. Orders
Your order is an offer to buy the products in it. A contract is formed only once we send you an order-confirmation email; until then we are not obligated to fulfill the order, and we may decline any order at our discretion. It is your responsibility to provide accurate contact, billing, and shipping details and a working email address, since order communications are sent by email.

5. Payment
By submitting payment details, you confirm that you are authorized to use the payment method and that the information is accurate. Payments are processed by third-party payment providers, whose own terms also apply. We are not responsible for any fees your bank or card issuer may charge.

6. Shipping, Delivery, Title, and Risk of Loss
We arrange shipment of your order to the address you provide. Delivery dates are estimates only and are not guaranteed, and we are not liable for shipping delays outside our control. Title and risk of loss pass to you once we hand the products to the carrier.

7. Refunds and Returns
Refunds and returns are handled under our Refund Policy. To start a refund or return, you must first contact us by email at support@elfoyo.com within the period stated in that policy. Returns are only accepted after they have been requested and approved by our support team.

8. Undeliverable Shipments and Returns Without Prior Contact
(a) If a shipment cannot be delivered because it was refused, not collected, or because of an incorrect address you provided, and it is returned to us or our logistics partner, we reserve the right to charge the actual shipping and handling costs incurred for any reshipment of the order.

(b) If the order is cancelled after such a return, we may deduct a processing fee of up to 30% of the original purchase price from your refund amount to cover the costs incurred (for example, return transport, transaction, and handling or storage costs). You remain free to demonstrate that no cost, or a lower cost, was actually incurred.

(c) Returns sent to us without first contacting our support team cannot be reliably identified and processed. In such cases we reserve the right to withhold a reasonable processing fee of up to 30% of the purchase price where demonstrable additional effort was incurred. 9. User Submissions
If you send us comments, reviews, ideas, or other submissions, you grant us the right to use, edit, publish, and display them without restriction and without any obligation to you. You agree that your submissions will not be unlawful, infringing, or harmful and will not violate anyone else's rights. We may, but are not obligated to, monitor or remove content we consider inappropriate.

10. Prohibited Uses
You may not use the site or our products: for any unlawful purpose; to solicit others to act unlawfully; to violate any laws or regulations; to infringe our or others' intellectual property; to harass, abuse, or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect others' personal information; to spam, crawl, or scrape; for any obscene or immoral purpose; or to interfere with the security of the site. We may terminate your access for any violation of these Terms.

11. Third-Party Links and Tools
The site may include links to, or tools from, third parties that we do not control or monitor. Your use of them is at your own risk and subject to the third party's own terms. We are not responsible for third-party content, products, or sites.

12. Disclaimer of Warranties; Limitation of Liability
To the fullest extent permitted by law, the site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, Elfoyo will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site or products. Where liability cannot be excluded, it is limited to the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you.

13. Indemnification
You agree to indemnify and hold Elfoyo harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

14. Governing Law
These Terms are governed by the laws of the United States and the state in which we are established, without regard to conflict-of-laws principles. (If you want a specific state named for governing law and venue, tell me which and I'll insert it.)

15. Dispute Resolution; Arbitration; Class-Action Waiver
Please read this section carefully, as it affects your legal rights. Except where prohibited by law, any dispute arising out of or relating to these Terms, our products, or our marketing will be resolved by binding individual arbitration rather than in court, and you and Elfoyo waive the right to a jury trial and the right to participate in a class or representative action. You may opt out of this arbitration agreement within 30 days of your first purchase by emailing us at support@elfoyo.com stating your intent to opt out. Nothing in this section prevents either party from seeking injunctive relief for the misuse or infringement of intellectual property.

16. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, pandemics, strikes, carrier delays, or utility or telecommunications failures.

17. Privacy
Your submission of personal information through the site is governed by our Privacy Policy.

18. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with our order confirmation, Privacy Policy, and Refund Policy, form the entire agreement between you and us regarding the site and your purchases. We may give you notice by email or by posting on the site.
